Item No: 6.1
Prepared by: Brandi West, Consultant Assistant Planner
Agenda Title: PLTX25-0001, Renewal of Site Plan and Architectural Review Approval for the El Roy’s Express Mex Remodel
Location: 6620 Commerce Boulevard (APN 143-061-064)
GP/Zoning: Commercial Regional/C-R: Regional Commercial
Applicant/Owner: Roy Cabrera, Owner/Paul Gilger, Applicant
RECOMMENDED ACTION: Staff recommends that the Planning Commission adopt
Resolution 2025-02 approving a one-year extension of the Site Plan and Architectural Review approval for the El Roy’s Express Mex restaurant remodel within the C-R zoning district at 6620 Commerce Boulevard, APN 143-061-064 (Figure 1 – Project Location).
Figure 1: Location Map
Page 2
BACKGROUND: The project is located on a 0.5-acre parcel in the central portion of the city in an area predominately characterized by existing developed parcels with commercial retail and
restaurant style businesses. The existing 1584 square foot restaurant building, formerly Wayne’s Grill and Sushi, was built in 1981, originally as a walk-in (no drive thru) Taco Bell. The property has been vacant since 2018 and is currently in a state of neglect and disrepair.
On December 8, 2022, the owner, Roy Cabrera, El Roy’s Express Mex Restaurant, received
Planning Commission approval for a Site Plan and Architectural Review (SPAR) for an exterior remodel and addition of an outdoor dining area. Per Rohnert Park Municipal Code 17.25.35, SPAR approvals expire one year from the Planning Commission approval date, unless prior to the expiration, a building permit was issued and construction commenced and diligently pursued toward completion; or an extension is requested pursuant to Section 17.25.035 of the Rohnert
Park Municipal Code. On November 20, 2023, the applicant submitted a timely application for a one-year extension to the SPAR approval. On January 25, 2024, the extension was approved by the Planning
Commission.
On January 24, 2025, the applicant submitted a timely application for an additional one-year time extension for the SPAR approval. The matter is being brought before the Planning Commission for its consideration. ANALYSIS: Pursuant to Zoning Ordinance Section 17.25.035, Lapse of Approval/Renewal for SPAR approvals:
A. A site plan and architectural review approval shall lapse one year after the date of final approval or at an alternative date specified at the time of approval, un-
less:
1. A building permit has been issued and construction has diligently commenced; or 2. A certificate of occupancy has been issued; or
3. The use is established; or
4. The site plan and architectural review approval is renewed in accordance
with subsection B below. 5. The project is a residential development that does not require the approval of a tentative subdivision map, or otherwise not vested through a development agreement with the city, then the approval shall expire after a
twenty-four-month period, unless extended for special circumstances by the city council.
B. A site plan and architectural review approval may be renewed for an additional period of one year, provided that prior to the expiration date, an application for
renewal is filed with the planning commission. The planning commission shall
not deny the renewal request without first holding a public hearing and making findings supporting the reason for denial. If the planning commission denies the renewal request, the applicant shall have ten calendar days to appeal the deci-sion to the city council as set forth in Chapter 17.25 Article XII.
Page 3
As previously stated, the applicant has filed the necessary application according to this provision and has indicated they are working through financial considerations and are close
to filing for the necessary building permit application and begin construction.
There have been no changes to the approved plans or surrounding area and the project will remain subject to the conditions as outlined in Resolution 2022-15, adopted by the Planning
Commission on December 8, 2022, attached as Exhibit 2 to Resolution 2024-01.
ENVIRONMENTAL DETERMINATION: The extension of the approval is exempt under CEQA 15061(b)(3) in that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
PUBLIC NOTIFICATION: A public hearing notice denoting the time, date and location of this hearing was published in the Community Voice. Property owners within 300 feet of the project site were mailed notices, and the notice was posted pursuant to State Planning Law.
