HomeMy WebLinkAbout2026/01/13 City Council Resolution 2026-008 RESOLUTION NO. 2026-008 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING A 180-DAY WAIT PERIOD EXCEPTION SPECIFIC TO THE APPOINTMENT OF RETIRED ANNUITANT TIMOTHY S. MATTOS TO THE VACANT POSITION OF DIRECTOR OF PUBLIC SAFETY (GOVERNMENT CODE SECTIONS 7522.56 & 21221(h)) WHEREAS, in compliance with Government Code section 7522.56 the City Council of the City of Rohnert Park must provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Timothy S. Mattos, retired from the City of Rohnert Park in the position of Director of Public Safety effective January 13, 2026; and WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is July 13, 2026 without this certification resolution; and WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS, the City Council of the City of Rohnert Park, the City of Rohnert Park and Timothy S. Mattos certify that Timothy S. Mattos has not and will not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS, the City Council of the City of Rohnert Park hereby appoints Timothy S. Mattos as an interim appointment retired annuitant to the vacant position of Director of Public Safety for the City of Rohnert Park under Government Code section 21221(h), effective January 14, 2026; and WHEREAS, an appointment under Government Code section 21221(h)requires an active, publicly posted recruitment for a permanent replacement; and WHEREAS, the City of Rohnert Park has an active and publicly posted recruitment, and is utilizing the services of an executive search firm to assist with recruiting a permanent replacement; and WHEREAS, this section 21221(h) appointment shall only be made once and therefore will end no later than December 31, 2026; and WHEREAS, the appointment document between Timothy S. Mattos and the City of Rohnert Park has been reviewed by this body and is attached hereto; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and 4- WHEREAS, the maximum monthly base salary for this position is $21,305.09 and the hourly equivalent is $122.91, and the minimum monthly base salary for this position is $17,527.72 and the hourly equivalent is $101.12; and WHEREAS,the hourly rate paid to Timothy S. Mattos will be $122.91; and WHEREAS, Timothy S. Mattos has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Rohnert Park hereby certifies the nature of the employment of Timothy S. Mattos as described herein and detailed in the attached appointment letter and that this appointment is necessary to fill the critically needed position of Director of Public Safety for the City of Rohnert Park by January 14, 2026 to ensure continuity of leadership and the effective management of the City's public safety operations. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute documents pertaining to same for and on behalf of the City of Rohnert Park. Mattos XXXXXXXXXXXXXXX XXXXXXXXXXXXXXX Dear Tim: Effective January 14, 2026, and pursuant to Government Code Section 21221(h), you are hereby appointed as a Retired Annuitant to the position of Interim Director of Public Safety while we are actively recruiting for a permanent replacement. You can only be appointed once to this position. You will perform critically needed public safety management duties as specified in the class specification for the position. Your employment is contingent upon and subject to the following conditions and understandings: 1. Your limited-term employment shall begin on January 14, 2026, and end on or before December 31, 2026. Your employment shall not exceed 960 hours per fiscal year (July 1 – June 30) for all employers who contract with CalPERS. It is your responsibility to ensure you do not exceed this limit. 2. Your rate of pay for the above position is $122.91/hour. You will not receive any other benefit, incentive compensation in lieu of benefit, or any other form of compensation in addition to this hourly rate. You will not be permitted to work overtime hours for the City without prior written approval from the City Manager. 3. As required by law, the City shall provide unemployment insurance, Medicare tax contributions and workers’ compensation insurance. 4. As a Retired Annuitant employee, your employment relationship with the City is at-will. The City Manager may terminate your employment at any time, with or without cause by providing seven (7) calendar days’ notice, subject to the required procedure for termination of Police Chiefs as provided in Government Code Section 3304(c). You must refrain completely from the use of tobacco products during all working hours during your employment with the City. No smoking is permitted within 20 feet of main entrances, exits, and operable windows.
