A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
AUTHORIZING AN AMENDMENT TO THE CITY OF ROHNERT PARK FISCAL
YEAR 2025-26 BUDGET TO INCREASE APPROPRIATIONS BY $15,000 FROM THE
HOUSING PROJECTS SEPCIAL REVENUE FUND BALANCE (FUND 5720)
WHEREAS, the City Council of the City of Rohnert Park adopted the Fiscal Year 2025-
26 Budget on June 10, 2025; and,
WHEREAS,the City Council has the authority to amend the budget; and,
WHEREAS,the adopted Fiscal Year 2025-26 Budget included an appropriation of
$15,000 from the Housing Projects Special Revenue Fund(Fund 5720), also known as the Low
and Moderate Income Housing Asset Fund(LMIHAF), for legal fees to support the
implementation of programs from the City's 2023-2031 Housing Element; and,
WHEREAS,the City requires additional legal services to support implementation of the
Housing Element, including compliance with state housing laws; and
WHEREAS,the City of Rohnert Park is required to adopt and maintain a Housing
Element that complies with the requirements of State Housing Element Law; and
WHEREAS,the funds in the Housing Projects Special Revenue Fund are Housing
Successor Agency Funds remaining from the former Redevelopment Agency; and,
WHEREAS, Housing Successor Agency funds are subject to the requirements of Health
and Safety Code Section 34176.1, which governs how Housing Successor funds may be
expended; and
WHEREAS,the use of Housing Successor Agency Funds for legal fees related to the
implementation of the Housing Element is an administrative activity that supports the monitoring
and preservation of affordable housing pursuant to Section 34176.1; and,
WHEREAS,there is sufficient fund balance in the Housing Projects Special Revenue
Fund to accommodate this transfer.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Rohnert
Park that does hereby authorize and approve an amendment to the to the Fiscal Year 2025-26
budget to increase appropriations by $15,000 from the Housing Projects Special Revenue Fund
balance.
BE IT FURTHER RESOLVED that the City Manager and Finance Director are
authorized and directed to take the actions necessary to effectuate this resolution.
