HomeMy WebLinkAbout2026/06/09 City Council Ordinance 994 ORDINANCE NO. 994 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING SECTION 10.20.010 OF THE ROHNERT PARK MUNICIPAL CODE TO ADJUST PRIMA FACIE SPEED LIMITS WHEREAS, local regulation of vehicle speeds are governed by the provisions of the California Vehicle Code; and WHEREAS, Chapter 7 of Division 11 of the California Vehicle Code generally requires that local speed limits be set by ordinance; and WHEREAS,the California Vehicle Code allows such speed limits to be set only upon the basis of an engineering and traffic survey; and WHEREAS,the City has performed engineering and traffic surveys on Adrian Drive, Arlen Drive, Bodway Parkway, Business Park Drive, Camino Colegio, Commerce Boulevard, Country Club Drive, East Cotati Avenue, Enterprise Drive, Golf Course Drive, Golf Course Drive West, Labath Avenue, Redwood Drive, Roberts Lake Road, Rohnert Park Expressway, Seed Farm Drive, Snyder Lane, Southwest Boulevard, State Farm Drive, and Valley House Drive. NOW, THEREFORE,the City Council of the City of Rohnert Park does ordain as follows: SECTION 1. Section 10.20.010 of the Rohnert Park Municipal Code is hereby amended in its entirety to read as follows: "10.20.010—State speed limits—Inappropriate It is determined upon the basis of an engineering and traffic survey investigation that the speed permitted by state law upon the following streets is inappropriate for the safe operation of vehicles thereon. It is declared that the prima facie speed limit on the streets or portions of streets, hereinafter designated, to facilitate the orderly movement of traffic and which has been found to be reasonable and safe, after the installation of appropriate signs giving notice thereof, shall be: Adrian Drive 25 m.p.h. Arlen Drive 25 m.p.h. Bodway Parkway 35 m.p.h. Business Park Drive 35 m.p.h. Camino Colegio between E. Cotati Avenue and Bodway Parkway 35 m.p.h. Camino Colegio between Southwest Boulevard and E. Cotati Avenue 25 m.p.h. Commerce Blvd between Golf Course Drive and Professional Center Drive 35 m.p.h. Commerce Blvd between Professional Center Drive and Avram Avenue 30 m.p.h. Expressway State Farm Drive between Rohnert Park Expressway and Enterprise Drive 30 m.p.h. Valley House Drive 40 m.p.h. SECTION 2. Severability. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it should have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. SECTION 3. Environmental Review. This action is exempt from the California Environmental Quality Act(CEQA)pursuant to CEQA Guidelines sections 15061(b)(3) and 15301. SECTION 4. Effective Date. This Ordinance shall be in full force and effective thirty (30) days after its adoption and shall be published and posted as required by law.
