A RESOLUTION OF THE CITY OF ROHNERT PARK AUTHORIZING THE CITY
MANAGER AND THE CITY ATTORNEY TO SETTLE CERTAIN SUITS IN WHICH
THE CITY OF ROHNERT PARK IS A PARTY
WHEREAS, the City of Rohnert Park is engaged in litigation both as a
plaintiff and as a defendant; and
WHEREAS, some of the litigation terminates by settlement or dismissal
wherein neither party pays nor gives any monetary consideration to the other
party; and
WHEREAS, the City Council desires to delegate the authority to settle
or terminate such litigation to the City Manager with the approval of the
City Attorney under the following conditions:
1. That the proposed settlement or termination of the litigation is
reviewed with the Rohnert Park City Council before the suit is settled or
otherwise terminated.
2. That no monetary consideration passes from the City of Rohnert
Park to the opposite party (ies).
3. That no other consideration, except for nominal consideration, is
given by the City of Rohnert Park to the opposite party (ies) without the
prior review and approval by the Rohnert Park City Council.
NOW, THEREFORE, BE IT RESOLVED by the Rohnert Park City Council that
it does hereby authorize the Rohnert Park City Manager, with the consent
and approval of the Rohnert Park City Attorney, to enter into written settle-
ment agreements in litigation and to enter dismissals of the same, with or
without prejudice, wherein the City of Rohnert Park is a plaintiff or a de-
fendant under the terms and conditions hereinabove set forth.
DULY AND REGULARLY PASSED AND ADOPTED by the Rohnert Park City Council
this 10th day of December, 1984.
